Welcome to www.nousmadic.com (the “Website”), operated by Nousmadic (“Nousmadic”, “we”, “our”, or “us”).
Nousmadic is a General Partnership registered in England and Wales.
These Terms and Conditions (“Terms”) govern your access to and use of the Website and your purchase of any products through the Website. By using our Website, you agree to be bound by these Terms and our Privacy Policy.
If you do not agree with any part of these Terms, please do not use the Website.
1. PRODUCTS AND ORDERING
1.1 Product Description
Nousmadic offers fine art photographic prints made-to-order and shipped by a third-party professional printing and fulfillment partner, the printspace. As a result, we do not personally handle or inspect each print before shipping. Fulfillment times and shipping durations may vary.
1.2 Accuracy
We strive to ensure that all product descriptions, images, and pricing are accurate and up-to-date. However, we do not guarantee that any content is error-free, complete, or current. Slight variations in color and crop may occur due to monitor differences or production limitations.
1.3 Order Acceptance
All orders placed through the Website are subject to acceptance by Nousmadic. We reserve the right to reject or cancel any order at our sole discretion, including but not limited to orders we suspect are fraudulent or that violate these Terms.
All orders are subject to availability. Once you place an order, you will receive a confirmation email. This email does not constitute acceptance of your order, which occurs only when we dispatch the item.
2. PAYMENT
2.1 Pricing
All prices are listed in GBP (£) and include UK VAT where applicable.
We reserve the right to modify pricing without notice.
Shipping fees will be added at checkout and may vary depending on the destination.
2.2 Payment Methods
We accept major credit and debit cards, PayPal, and other payment methods as shown at checkout. Payments are processed securely through third-party payment gateways.
2.3 Taxes and Duties
Buyers are responsible for any import taxes, customs fees, or duties applicable in their country.
3. SHIPPING & DELIVERY
3.1 Fulfilment
Prints are fulfilled by a third-party supplier (the printspace) and shipped directly to the customer. Delivery times may vary based on your location, the time of year, and other factors outside our control.
While we strive to meet all estimated delivery timelines, Nousmadic shall not be held liable for any delays in shipping or delivery caused by events beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, war, strikes, civil unrest, or delays caused by customs or third-party service providers. In such cases, we will make reasonable efforts to keep you informed and fulfil your order as soon as practicable.
3.2 Customs & Duties
International orders may be subject to customs duties, taxes, or import charges. These are the responsibility of the customer and are not included in the purchase price or shipping cost.
3.3 Delivery Issues
Nousmadic is not responsible for delays, losses, or damages incurred during shipping. However, we will assist customers in resolving delivery issues with our fulfilment partners to the extent possible.
4. RETURNS & CANCELLATIONS
4.1 Made-to-Order Policy
All prints are made-to-order and therefore non-refundable and non-returnable, except in the case of damage.
By placing an order for a made-to-order item, you acknowledge that production will begin immediately. Therefore, you consent to the loss of your right to cancel under the Consumer Contracts Regulations 2013 once production begins, unless the item is faulty or damaged.
Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015. In the unlikely event that the product is faulty, not as described, or not fit for purpose, you may be entitled to a refund, repair, or replacement, in accordance with UK consumer law.
Please Note on Made-to-Order Prints
Each print is made to order just for you, and slight variations in colour, cropping, or scale may occur due to the custom nature of the process. These variations do not affect the quality or purpose of the product and are not considered faults. However, if your print arrives damaged, significantly different from what was described, or unfit for display, please contact us — we’ll make it right.
4.2 Damaged Items
In the rare event that your artwork arrives damaged, please contact us within 48 hours of delivery and include clear photographs of the damage. Once the issue is verified, we will make every effort to replace the print at no additional cost. If a replacement is not possible, we will issue a full refund upon return of the damaged artwork along with the original Certificate of Authenticity (if applicable).
4.3 Order Changes or Cancellations
Once an order is placed, it cannot be modified or cancelled as production begins immediately through our third-party partner.
The only exception is the delivery address, which can be changed if your order has not yet been shipped. To change the address for an unshipped order, please contact us.
5. INTELLECTUAL PROPERTY
All content on the Website, including but not limited to images, text, graphics, and logos, is the intellectual property of Nousmadic or its licensors and is protected by copyright and other intellectual property laws.
You may not use, reproduce, or distribute any content without express written permission from Nousmadic.
6. USER CONDUCT
You agree not to use the Website in any way that:
- Violates any applicable law or regulation;
- Infringes upon the rights of Nousmadic or any third party;
- Disrupts or interferes with the operation of the Website;
- Introduces any harmful code or malware.
7. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Nousmadic shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from:
- Your use of or inability to use the Website;
- Any errors or omissions in the content;
- Delays or issues with third-party services including printing or shipping.
Our total liability to you shall not exceed the total purchase price of the products you have purchased.
8. INDEMNIFICATION
You agree to indemnify and hold Nousmadic and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the Website, your breach of these Terms, or your violation of any rights of a third party.
9.THIRD-PARTY SERVICES
This website may contain links to third-party sites, such as payment processors and fulfillment providers, that are not affiliated with Nousmadic. We do not take responsibility for reviewing or verifying the content or accuracy of these external websites, and we make no warranties nor accept any liability for third-party websites, materials, products, or services.
We are not responsible for any loss or damage arising from your purchase or use of goods, services, resources, content, or any other transactions made through third-party websites. We strongly advise reviewing the third party’s own policies and terms before engaging in any transaction. Any questions, complaints, or concerns regarding third-party products should be directed to the relevant third party.
10. PRIVACY
Nousmadic processes your personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
Your use of the Website is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.
11. SEVERABILITY
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.
12 – TERMINATION
The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.
These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.
If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).
13 – ENTIRE AGREEMENT
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitute the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).
Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.
14. GOVERNING LAW & JURISDICTION
These Terms shall be governed by and construed in accordance with the laws of United Kingdom. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
15. ONLINE DISPUTE RESOLUTION
If you are a consumer and we cannot resolve your complaint through our internal process, you may be entitled to use the EU’s Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr.
We are not obliged to use ADR and may choose whether or not to participate on a case-by-case basis.
16. FORCE MAJEURE
Nousmadic shall not be liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, pandemics, strikes, supply chain disruption, or failures of third-party services.
17. CHANGES TO TERMS
Nousmadic reserves the right to update or modify these Terms at any time without prior notice. Your continued use of the Website following any changes constitutes your acceptance of the new Terms.
